Is it legal to get an abortion in Texas if I’m under 18?

Yes. It is legal to get an abortion in Texas if you are a minor.

If you are under 18, Texas requires one of your parents, a legal guardian, or a judge to give permission for your abortion and to be told of your decision prior to the abortion. Here is the form your parent or legal guardian must fill out.

If getting the permission of a parent or legal guardian is not an option for you, Texas provides a few alternatives:

  • You can ask a judge to excuse you from getting permission or telling your parent or guardian. (This is called a “judicial bypass.”)
  • If you are legally emancipated, you do not need to get a parent’s permission or notify them.

If you are live in a nearby state, or plan to have your abortion in a nearby state, it is important to be familiar with their abortion laws.

Arkansas
If you are under 18 and need an abortion in Arkansas, your state requires that one of your parents give permission for your abortion. A judge can excuse you from this requirement.

Louisiana
Your state requires that one of your parents give permission for your abortion if you are under 18. A judge can excuse you from this requirement.

New Mexico
Your state does not have any parental involvement requirements. This means that you do not need to notify or get the consent from anyone to have an abortion in New Mexico if you are under 18.

Oklahoma
If you are a minor and need an abortion in Oklahoma, your state requires that one of your parents be told of your decision at least 48 hours before the abortion takes place, and your parent must give permission for the abortion. A judge can excuse you from these requirements.
